1. INFORMATION ABOUT ALLTERN8.COM

2. ACCEPTANCE OF TERMS

You are expected to check this page from time to time to take notice of any changes Alltern8.com made, as they are binding on you. Alltern8.com provides users with access to a rich collection of on-line resources, including, various communications tools, online forums, marketplace services, downloadable content, personalised content and branded programming through the Website (the Services). Unless explicitly stated otherwise, any new features that augment or enhance the current Services, including, without limitation, the release of new Website properties, shall be subject to these Terms of Service.
You acknowledge and agree that the Services are provided "AS IS" and that Alltern8.com assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalisation settings.
In order to use the Service, you must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service and/or telephony fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device. Please be aware that Alltern8.com has created certain areas on the Service that contain adult or mature content. You must be at least 18 years of age to access and view such areas.

5. YOUR REGISTRATION OBLIGATIONS

In consideration of your use of the Services, you represent and warrant to: (a) provide true, accurate, current and complete information about yourself as prompted by the Services registration form (such information being Registration Data); and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

If you provide any information that is untrue, inaccurate, not current or incomplete, or Alltern8.com has grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Alltern8.com has the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any part thereof).

The Website is not moderated by Alltern8.com and instead each user agrees to be responsible for the moderation of the Website as a whole.

6. SAFETY AND CHILD PROTECTION

Alltern8.com is concerned about the safety and privacy of all its users, particularly children. For this reason, parents who wish to allow their children access to the Service should assist them in setting up any relevant accounts and supervise their access to the Service. By allowing your child access to the Service, they will be able to access all of the Services including, message boards, groups, instant messages and chat (among others). Please remember that the Service is designed to appeal to a broad audience. Accordingly, as the legal guardian, it is your responsibility to determine whether any of the Services and/or Content (as defined in Section 9 below) are appropriate for your child.

7. TERM

This Agreement shall remain in full force and effect while you use the Services or remain registered as a member (Member). You may terminate your membership at any time, for any reason, by accessing the your account profile page.

10. MEMBER ACCOUNT, PASSWORD AND SECURITY

You will receive a password and account designation upon completing the Services registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) notify Alltern8.com immediately of any unauthorised use of your password or account and any other breach of security, and (b) ensure that you exit from your account at the end of each session. Alltern8.com cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 10 or these Terms of Service.

Alltern8.com reserves the right to deactivate user accounts and user names at any time and for any reason including, without limitation, any account that has been inactive for more than 180 days.

11. MEMBER CONDUCT

WE ARE ALL RESPONSIBLE FOR THIS COMMUNITY

It is Alltern8.coms objective that the Website is used to promote an interesting and open exchange of views whilst ensuring that the Website is a safe environment for its intended participants.

It is the responsibility of all users of the Website to maintain a safe and harmonious community and Alltern8.com expect you to:

use any other members' personal data for purposes other than establishing contact that is reasonably expected to be welcomed by such other members;
forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service or Website;

disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
intentionally or unintentionally violate any applicable law or regulation including, but not limited to, regulations promulgated by any securities exchange;
defame, abuse, harass, stalk, bully, threaten or otherwise violate the rights (such as rights of privacy and publicity) of others;

flaming, denigration and calls to action against third parties;

post another members profile information without his or her prior consent;
air personal disputes or grievances between users or third parties;
use the Service in any unlawful manner or in any other manner that could damage, disable, overburden or impair the website;
attempt to gain unauthorised access to the Service or Website, other accounts, computer systems or networks connected to the Service, through password mining or any other means;

Collect. store, or transmit personal data about third parties or other users.

You acknowledge that Alltern8.com does not pre-screen Content, but that Alltern8.com and persons designated by Alltern8.com shall have the right (but not the obligation) in their sole discretion to refuse or move any Content that is available via the Services. Without limiting the foregoing, Alltern8.com and its designates shall have the right to remove any Content that violates the Terms of Service or is otherwise objectionable. You acknowledge that the technical processing and transmission of the Services and Website, including your Content, may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Alltern8.com reserves the right to terminate your access to some or all parts of its Services or Website if you withdraw your consent to these Terms of Service at any time.

12. NON-COMMERCIAL USE BY MEMBERS

The Services are for the personal use of Members and users only and may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by Alltern8.com. Illegal and/or unauthorised use of the Services, including collecting usernames and/or email addresses of Members or users by electronic or other means for the purpose of sending unsolicited email or unauthorised framing of or linking to the Website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member profiles, the Services and the Website without notice and may result in termination of membership privileges. Appropriate legal action will be taken for any illegal or unauthorised use of the Services.

13. INTERNATIONAL USE

By using the Services or Website you represent and warrant that such use is permitted by the local laws of the country in which such access is made and you represent and warrant that you have and will continue to comply with all applicable local laws and rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data in the United Kingdom, the country in which you reside and any country from which you access the Services or Website (if different from the aforementioned).

14. LICENCE

15. INDEMNITY

You agree to indemnify and hold Alltern8.com and any group undertaking (as defined in section 1161(5) of the Companies Act 2006), officers, agents, co-branders and other partners, and employees, (the Indemnified Parties) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party arising directly or indirectly out of Content you submit, post to or transmit through the Services or Website, your use of the Services or Website, your connection to the Services or Website, your violation of the Terms of Service, or your violation of any rights of another. The Indemnified Parties may enforce the terms of this agreement against you for the purpose of giving effect to this indemnity.

16. NO RESALE OF SERVICE

17. GENERAL PRACTICES REGARDING USE AND STORAGE

You acknowledge that Alltern8.com may establish general practices and limits concerning use of the Services, including with out limitation the maximum number of days that messages, message board postings or other uploaded Content will be retained by the Services, the maximum number of messages that may be sent from or received by an account on the Services, the maximum size of any message that may be sent from or received by an account on the Services, the maximum disk space that will be allotted on Alltern8.com's servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Services in a given period of time.

You acknowledge and agree that Alltern8.com has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Services.

23. PROPRIETARY RIGHTS

The proprietary rights and confidential information are protected by applicable intellectual property and other laws.

If you intend to create or join any service, receive or request any news, messages, alerts or other information from the Website or Services concerning companies, stock quotes, investments or securities, please read the above Sections 24 and 25 again.. In addition, for this type of information particularly, the phrase "Let the investor beware" is apt. The Service is provided for informational purposes only, and no Content included in the Service is intended for trading or investing purposes. Alltern8.com shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted via the Service, and shall not be responsible or liable for any trading or investment decisions made based on such information.

28. WRITTEN COMMUNICATIONS

Applicable laws require that some of the information or communications Alltern8.com send to you should be in writing. When using the Website and Services, you accept that communication with Alltern8.com will be mainly electronic. Alltern8.com will contact you by e-mail or provide you with information by posting notices on the Website or otherwise through the Services. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that Alltern8.com provide to you electronically comply with any legal requirement that such communications be in writing.

29. NOTICES

All notices given by you to Alltern8.com must be given to Alltern8 at Unit 1, The Courtyard, Crows Hall Farm, Chilgrove Road, Chilgrove, West Sussex, PO18 9H, England or admin@alltern8.com. Alltern8.com may give notice to you by e-mail, by posting on the Website, through the Services, or post to any address registered on your user account or any address you have otherwise provided to Alltern8.com in accordance with this section 28. Notices will be deemed received and properly served immediately when posted on the Website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

30. TRADE MARK INFORMATION

Alltern8.com the Alltern8.com Marks are trade marks of Alltern8.com. Without Alltern8.com's prior permission, you agree not to display or use in any manner, the Alltern8.com Marks.

31. GENERAL INFORMATION

These Terms of Service (including the guides and rules referred to herein) constitute the entire agreement between you and Alltern8.com and govern your use of the Service, superseding any prior agreements between you and Alltern8.com. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software.

The Terms of Service and the relationship between you and Alltern8.com (including non-contractual disputes or claims) shall be governed by the laws of England and Wales. You and Alltern8.com agree to submit to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms of Service limits the right of Alltern8.com to bring proceedings against you arising out of or in connection with your use of the Services in any other court of competent jurisdiction or concurrently in more than one court of competent jurisdiction.

Any failure by Alltern8.com to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. If any provision of the Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Service remain in full force and effect.

The section titles in the Terms of Service are for convenience only and have no legal or contractual effect.

You agree that your Alltern8.com account is non-transferable and any rights to your Alltern8.com ID or contents within your account terminate upon your death. Any free account that has not been used for a certain period of time may be terminated and all contents therein permanently deleted in line with Alltern8.com's policy.

32. THIRD PARTY RIGHTS

A person who is not a party to this agreement shall not have any rights under or in connection with it by virtue of the Contracts (Rights of Third Parties) Act 1999 except where such rights are expressly granted in Section 15. Notwithstanding the foregoing the rights of the parties to terminate, rescind or agree any variation, waiver or settlement under this agreement is not subject to the consent of any person that is not a party to this agreement.

Alltern8.com welcomes and offers many differing opinions and experiences. You are certain to find opinions that you disagree with and some which you may find offensive. Our aim is to provide a place where a free exchange of ideas and expression can take place whilst offending as few people as possible.

Alltern8.com will try to be as fair as possible when responding to complaints but in a large community of users, with differing viewpoints, there will always be some people that will not be happy with the outcome. Whilst this is regrettable Alltern8.com expect users to respect the fact that decisions are made on what is felt is best for the community as a whole.

Please note that abuse reports are intended to be confidential and will not be disclosed to the user who posted the item unless this is required by law.

Alltern8.com does not guarantee to moderate any post or topic, or to do so within a specific time period. Alltern8.com may or may not accept that the issue you report breaches these Terms of Service and the final decision will remain with Alltern8.com.

If your post is modified, edited or deleted, you will be sent a message by Alltern8.com. In some cases the post may stand but a warning may be given to the user.
